Terms of Service

Welcome to the Terms of Service for Rhythm Seven Software. These Terms of Service ("Terms") govern your access to and use of our website (rhythmseven.com), services, our desktop applications ("the Software"), and the R7.Activator application. By accessing or using our services, purchasing a software license, or activating a license, you agree to be bound by these Terms. If you do not agree, please do not use our services. These Terms apply to all customers and potential customers, as defined in our Legal Policies.

1. Definitions​

  • Software: The cross-platform desktop applications (Windows and macOS) provided by Rhythm Seven Software, accessible through a valid license.
  • Software License: A right granted upon purchase to use the Software on up to three (3) computers concurrently. The license is non-transferable, meaning it cannot be sold, gifted, or assigned to another person or entity.
  • R7.Activator: A cross-platform application (Windows and macOS) that allows a user to activate, deactivate, and manage their Software License using an Activation Code.
  • Activation Code: A unique code emailed to you upon purchase, used with your registered name within the R7.Activator to activate your license on up to three (3) computers.
  • API: Our web server's Application Programming Interface, used by the R7.Activator to securely verify and manage licenses.
  • Services: Includes the rhythmseven.com website, the Software, the R7.Activator, the API, and all related support services.

2. Eligibility​

You must be at least 18 years old or have the legal authority to enter into these Terms on behalf of an entity. By using our Services, you represent that you meet these requirements.

3. License to Use the Software​

3.1 Grant of License: Upon purchasing a Software License and successfully activating it, Rhythm Seven Software grants you a non-exclusive, revocable license to install and use the Software on up to three (3) computers for personal or business purposes, subject to these Terms. This license is non-transferable and cannot be sold or reassigned to another person or entity; however, you may transfer activations between your own computers as described below.

3.2 License Activation: To activate your license, you must enter your registered name and a valid Activation Code into the R7.Activator. The R7.Activator securely hashes this information before sending it to our API for verification. Upon success, a license file is installed on your computer, and your available activation count is reduced.

3.3 License Deactivation, Transfer, and Reset: You have the following options for managing your activations via the R7.Activator, both of which require an internet connection:

  • Deactivation: You may deactivate a license on one computer to free up an activation slot. This allows you to then activate the license on another computer, provided the total number of active computers does not exceed three.
  • Reset (Deactivate All): You may use the "Deactivate All" function to remotely deactivate the license on all computers at once. This function is designed to help you recover activations from computers you no longer have access to. Using this feature will reset your available activation count to the maximum of three.

3.4 License Restrictions: You may not:

  • Use the Software License on more than three (3) computers concurrently.
  • Share your Activation Code or Software License with any other person or entity.
  • Copy, modify, distribute, sell, or rent the Software or its license file.
  • Reverse-engineer, decompile, or otherwise attempt to discover the source code of the Software or the R7.Activator.
  • Attempt to tamper with, bypass, or interfere with the license verification, activation, or deactivation processes.

3.5 Trial Version: Trial licenses for our paid software applications are automatically installed when the application is first launched, providing a 15-day evaluation period. Trial versions are subject to these Terms but may have limited functionality or duration. Trial licenses expire automatically and are offered free of charge.

4. Use of the Website and API​

4.1 Website Access: You may access rhythmseven.com to purchase a license, download setup files, view documentation, or submit inquiries via our Contact Form. You agree to use the website in compliance with all applicable laws and these Terms.

4.2 API Usage: The API is intended for the exclusive use of the R7.Activator to manage licenses. You agree not to access, overload, or interact with the API through any other means.

5. Purchases and Refunds​

5.1 Purchases: A Software License is purchased via our website, with payment processed by Stripe. Upon successful payment, our server generates a unique Activation Code and sends it to you via email. The Activation Code, together with your registered name, is required to activate your license using the R7.Activator on up to three (3) computers.

5.2 Refunds: You may request a refund within fifteen (15) days of purchase for any reason, no questions asked, as detailed in our Refund Policy. Your eligibility is not affected by whether you have activated the license.

6. Your Responsibilities​

You agree to:

  • Provide accurate and current information when making a purchase or contacting support.
  • Keep your Activation Code confidential and secure from unauthorized use.
  • Use the R7.Activator to manage your activations within the three-computer limit.
  • Use all Services, including the Software and the R7.Activator, in compliance with these Terms and all applicable laws.
  • Notify us promptly via our Contact Form if you suspect any unauthorized use of your license or Activation Code.

7. Intellectual Property​

All content, trademarks, and intellectual property related to the rhythmseven.com website, the Software, the R7.Activator, and our documentation are the exclusive property of Rhythm Seven Software and its licensors. They are protected by copyright and other intellectual property laws. Your license grants you the right to use our software but does not grant you ownership of it.

8. Privacy​

Your privacy is important to us. Our collection and use of your personal information are governed by our Privacy Policy. By using our Services, you consent to the data practices described therein.

9. Termination​

9.1 By You: You may terminate your Software License at any time by uninstalling the Software and destroying the license file on all activated computers. Termination does not entitle you to a refund if your purchase falls outside our Refund Policy.

9.2 By Rhythm Seven Software: We reserve the right to terminate or suspend your license and access to our Services immediately, without prior notice, if you violate these Terms. Upon termination, your Activation Code will be disabled, and you must cease all use of the Software and destroy all copies of its license file.

10. Disclaimers and Limitation of Liability​

10.1 Disclaimers: Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free.

10.2 Limitation of Liability: To the maximum extent permitted by law, Rhythm Seven Software shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of our Services. Our total liability to you for any and all claims shall not exceed the amount you paid for your Software License.

11. Governing Law and Dispute Resolution​

These Terms shall be governed by and construed in accordance with the laws of the state of New South Wales, Australia, without regard to its conflict of law principles. You agree that any legal action or proceeding arising out of or related to these Terms shall be brought exclusively in the state or federal courts located in Sydney, New South Wales, and you irrevocably consent to the jurisdiction of such courts.

12. Changes to These Terms​

We may revise these Terms from time to time. The most current version will always be posted on this page. By continuing to access or use the Services after revisions become effective, you agree to be bound by the revised Terms.
